Certain laws and regulations may restrict an organization’s ability to provide goods or services to a particular country or otherwise do business in that country—and these laws may impose penalties for violations. Employers must educate their employees to recognize their responsibility to comply with export controls and anti-boycott law.
 
 
Why Train on Export Controls and Anti-boycott Law?
In order to avoid potential civil and criminal penalties, organizations must abide by all applicable trade sanctions and export controls when doing business. This includes determining whether an export license is needed for a particular product or a particular country. In addition, US anti-boycott law encourages, and sometimes requires, US organizations, and in some cases their foreign subsidiaries, to refuse to participate in foreign boycotts that are not sanctioned by the US government. Employees must be able to identify when an export license may be required, to pay attention to unusual terms and circumstances in all contracts and related business dealings, and to notify designated officials within the organization when such circumstances arise.
 
 
What Does this Course Cover?
This course teaches employees what they need to know about defense exports under the State Department's International Traffic in Arms Regulations (ITAR), commercial exports under the Commerce Department's Export Administration Regulations (EAR), and red-flag issues involving export control and anti-boycott law.
 
Employees will learn practical skills to aid them in identifying potential violations of the law. In particular, the course teaches:
 
  • What qualifies as an export under US law, including information on types of exports and "deemed exports."
  • How exports are regulated by the US government.
  • What restrictions on exports apply under EAR.
  • What items are subject to ITAR.
  • How to identify export control red flags.
  • The purpose of anti-boycotting law and applicable provisions.
  • Penalties for noncompliance.
  • Questions to ask at the beginning of a project about export control and anti-boycotting law.
 
 
How is the Course Information Delivered?
Through a series of scenarios and interactive exercises, employees learn how to identify and respond to potential violations of export controls and anti-boycott law. Employeesare asked to answer multiple choice questions where they consider the possibleoutcomes and implications of hypothetical situations. They are also required to correctly answer three questions in a ‘Quiz Show’ exercise in order to complete the course. The course concludes with customized information about how to get assistance and report concerns within your organization.
